The Office of the Special Prosecutor has been directed by the Human Rights Court presided over by Justice Nicholas Mensah Abodakpi to respond to claims presented by Charles Bissue.
The former secretary of the Inter-Ministerial Committee on Illegal Mining (IMCIM), Charles Bissue, is seeking an order from the court to quash an arrest warrant he alleges is in possession of the OSP obtained from the Kaneshie District Court for his arrest.
Mr. Bissue also wants the Court to order the OSP to untag him a wanted man.
The above demands, is what state prosecutors petitioned the court to dismiss for lacking merit and having no viable course of action.
The state prosecutors told the Court Mr. Bissue could not substantiate his arrest warrant claims with evidence and that the OSP has the right to declare any person they could not locate as wanted.
At the hearing Thursday, October 26, 2023, the court dissented with the state prosecutor, ruling that human tights actions must not be dismissed but rather be heard on their merits, thereby ordering the OSP to file an official response to Mr. Bissue’s motion.
Mr. Bissue filed many lawsuits against the OSP to stop it from investigating and prosecuting him but has dropped them all with the exception of the matter in contention and one other.
In the other case, Mr. Bissue is seeking an order from the Human Rights Court to prevent the OSP from investigating and prosecuting him, unless investigative journalist Anas Aremeyaw Anas is also prosecuted since he allegedly offered the bribe that is under investigation.
In June 2023, the same Court placed an injunction on the OSP from arresting Mr Bissue after he was declared wanted for 10 days.
The Court was to deliver reasons for injuncting the OSP from carrying out its statutory duty in 7 days.
