The Attorney Generals Department in Kumasi has been petitioned over the delay in prosecuting a suspect in courtsince June this year.
The complainant, Mr. Lawson Otoo, CEO of Ikson Properties Agency Limited stated that the suspect, Mercy Agyei then a student of the Accra Technical University in 2019 while on an industrial attachment at Ikson Properties Agency Limited was sent to collect GHc75,000 from a client, Electroland Ghana Limited at Kaase in Kumasi.
It was alleged that the suspect, currently a contract worker of the Adum branch of ABSA Bank Ghana, collected the said amount from the Electroland Ghana Limited on November 2, 2019 , endorsed an official receipt n respect of the payment but refuse to pay the amount in the Company’s account and kept the money and thereafter went into hiding.
According to the complainant, Mercy Agyei, did not only refuse to answer calls from the company but also moved out of her known place of abode at South Suntreso in Kumasi.
The company subsequently found out about the fraud and reported it to the Asokwa Divisional Police Command.
Suspect Mercy Agyei, 28, was arrested on June 29 night at a hideout at Ayigya, a suburb of Kumasi and detained overnight for allegedly stealing GHc75,000
Having confirmed the signature on the receipt to the police, the suspect was granted police enquiry bail on June 30, 2024 at the instance of the Asokwa Police Divisional Commander, Chief Superintendent Acheampong pending investigations.
Even though investigations have been completed the case has not been prosecuted in court.
The complainant suspects that the conduct of the Asokwa Divisional Police Commander seeks to aid and abet the suspect with the pretext that he is acting on “orders from above” not to take the matter to court.
The petitioner, through his solicitor, P. Asante Nnuro and Associates Limited, contends that the continued delay and refusal of the Police chief to prosecute the case in court is causing substantial hardship and loss to the company hence to petition dated Spetember 5, 2024 to seek AG’s intervention for the expeditious determination of the matter “The Republic versus Mercy Agyei”.
