In a significant development, the Kumasi High Court has set aside an application for substituted service filed by the National Democratic Congress (NDC) in a parliamentary election petition case. The application, which sought to effect service on the respondents through alternative means, was dismissed by the court.
The decision was predicated on the grounds that the applicant had failed to adhere to the requisite procedures and protocols governing substituted service.
The court held that due process had not been followed, thereby rendering the application defective.
The parliamentary election petition, is contesting the 2024 election results for Obuasi East, Ahafo Ano North, and Ahafo Ano South West constituencies in the Ashanti Region.
Counsel for the first respondents had filed a motion to set aside the application, arguing that the NDC had not complied with the relevant rules of court. The court’s ruling upholds this contention, emphasizing the importance of adherence to procedural rules in election petition proceedings.
This development may have significant implications for the parliamentary election petition, as lawyers of the first respondents have agreed to receive the application and so they will return to court on April 4,2025.
