Action Peoples Party Seeks Injunction Against Electoral Commission

The Action Peoples Party, along with it parliamentary candidate,David Ankoma, has filed a motion at the High Court in Accra seeking an interlocutory injunction against the Electoral Commission of Ghana.

The motion, filed on August 22, 2025, requests the court to restrain the Electoral Commission and its agents from conducting the upcoming by-election in the Akwatia Constituency, scheduled for September 2025.

The plaintiffs argue that the by-election should be halted until the final determination of their case, which is currently before the court. The case is grounded in an affidavit filed by the plaintiffs, detailing the grounds for their application.

The motion is set to be heard on a date to be determined by the court, with the plaintiffs’ counsel, Dr. Yaw Anokye Frimpong, requesting that the matter be moved on a day-to-day basis. The court has been asked to grant the injunction pending the final determination of the case.

The outcome of this case could have significant implications for the by-election in the Akwatia Constituency. If the court grants the injunction, it could potentially delay or even cancel the by-election. The Electoral Commission has not yet commented on the matter.
